Terms of Use
These terms are an agreement between you and Andrii Korsun (“we”), an individual developer based in Denmark who operates BAZE. By using BAZE you accept them. If you don't, please don't use the app.
Who can use BAZE
You must be at least 13, and old enough to agree to these terms where you live (or have a parent's permission). Categories marked 18+ are for adults only.
Playing fair
BAZE is about laughing with your friends, not at someone's expense. You agree not to:
- use a name, photo or text that is hateful, sexual, threatening, or that harasses or bullies anyone;
- upload a photo of someone else without their permission, or pretend to be someone;
- share other players' photos or face shots outside BAZE without their consent;
- cheat, interfere with the service, or try to access data that isn't yours.
We may remove content or suspend accounts that break these rules. To report a player or content, write to support@getbaze.app.
Your content
You keep the rights to your name, photos, face shots and what you write. You allow us to store and show them to the players of your games, only to run BAZE and only for as long as described in our Privacy Policy. Cards you choose to share outside BAZE are shared by you.
BAZE Premium
- Premium is an auto-renewing subscription, billed through your Apple ID at the price shown before you buy.
- If a free trial is offered, you're charged when it ends unless you cancel at least 24 hours before.
- The subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Manage or cancel it in your iPhone's Settings → your name → Subscriptions.
- Refunds are handled by Apple under its terms.
- We may change what Premium includes or its price; a new price applies only from your next renewal, after Apple notifies you.
Our content
The app, its questions, art, sounds and code belong to us or our licensors. We give you a personal, non-transferable licence to use BAZE for your own non-commercial fun, under these terms and Apple's Standard End User License Agreement.
Other players and what they post
Names, photos, face shots, answers, votes and Pandora entries come from the players, not from us. We don't review them before they're shown and we don't endorse them. You're responsible for what you post and for how you treat the people you play with; we aren't responsible for anything another player posts, says or does, in the app or outside it (for example if someone takes a screenshot of you). BAZE is a party game: the questions, awards and results are jokes, not statements of fact about anyone.
No warranties
To the fullest extent permitted by law, BAZE is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability and non-infringement. We don't promise that BAZE will be uninterrupted, secure, error-free or free of harmful components, that any content or result will be accurate, or that your data, scores, parties or purchases' benefits will be kept. We may change, suspend or end BAZE or any part of it at any time.
Limitation of liability
To the fullest extent permitted by law, we (and anyone acting for us) are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, content, profits, revenue, goodwill or opportunity, or for damage to your device, arising out of or related to BAZE, these terms, other players or their content, or third-party services, whatever the legal theory and even if we were told such damage was possible. Our total liability for all claims together is limited to the amount you paid us for BAZE in the 12 months before the event giving rise to the claim (or nothing, if you paid nothing).
Some laws don't allow these exclusions. Nothing in these terms excludes or limits liability that can't be excluded or limited by law, including for death or personal injury caused by negligence, for fraud, intent or gross negligence, or your mandatory rights as a consumer.
Your responsibility
To the extent the law allows, you'll compensate us for claims, losses and costs (including reasonable legal fees) brought by others that arise from content you posted, from your breaking these terms or the law, or from how you treated other players.
Apple
These terms are between you and us, not Apple. Apple isn't responsible for BAZE or its content, has no obligation to provide maintenance or support for it, and isn't responsible for any claims relating to BAZE (including product liability, legal or regulatory compliance, consumer protection and intellectual property claims). If BAZE fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; to the extent permitted by law Apple has no other warranty obligation. You confirm that you're not in a country subject to a US Government embargo or on a US Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Ending
You can stop using BAZE at any time and delete your account in the app (Profile → Delete account). We may suspend or end your access if you break these terms.
Copyright complaints (DMCA)
If you believe something in BAZE infringes your copyright, send our designated agent (Andrii Korsun, support@getbaze.app, subject “DMCA notice”) a notice that includes: your physical or electronic signature; the work you say is infringed; the material you say infringes it and where it is in BAZE; your contact details; a statement that you believe in good faith the use isn't authorized by the owner, its agent or the law; and a statement, under penalty of perjury, that your notice is accurate and that you're the owner or authorized to act for the owner. If we remove your content after such a notice and you believe that was a mistake, you can send a counter-notice with the information required by 17 U.S.C. § 512(g). We end the accounts of repeat infringers where appropriate.
Disputes and arbitration (if you live in the United States)
Please read this section carefully: it affects your rights, including your right to go to court and to bring a class action.
- Talk to us first. Before starting a claim, email support@getbaze.app with your name, your account ID (in Profile → Give Feedback), what the dispute is about and what you want. We'll both try in good faith to settle it within 60 days.
- Binding individual arbitration. If it isn't settled, you and we agree that any dispute arising out of or relating to BAZE or these terms will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, before a single arbitrator. The arbitration may be held by video, by phone, on written submissions, or in the county where you live. Fees are paid as the AAA's consumer rules provide, which limit what you pay. The Federal Arbitration Act governs this section.
- Exceptions. Either of us may instead bring an individual claim in small-claims court, or ask a court to stop the infringement or misuse of intellectual property.
- No class actions, no jury. You and we may bring claims only individually, not as a plaintiff or class member in any class, collective or representative proceeding, and the arbitrator may not combine claims of more than one person. You and we waive any right to a jury trial. If this class-action waiver is found unenforceable for a claim, that claim (and only it) goes to court and not to class arbitration.
- You can opt out. You may opt out of this arbitration agreement by emailing support@getbaze.app, subject “Arbitration opt-out”, with your name and account ID, within 30 days of first accepting these terms. Opting out doesn't affect anything else in these terms.
- Time limit. To the extent the law allows, any claim must be brought within one year after it arose.
Changes and law
We may update these terms; we'll change the date above and tell you in the app about significant changes. These terms are governed by the laws of Denmark (and, for the arbitration section, the Federal Arbitration Act). If you live outside the United States, disputes go to the Danish courts, without taking away the protection of the consumer laws or the courts where you live. If any part of these terms can't be enforced, the rest still applies, and that part applies to the fullest extent the law allows. If we don't enforce a right, we haven't given it up.
